In the State of California, there are different types of escrow companies. It is important to note that the Department of Business Oversight highly regulates escrow companies. The Department of Business Oversight (“DBO”) regulates all financial transactions of independent escrow companies in California pursuant to the Financial Code.
Unlike banks, title companies and a brokerage’s in house escrow companies, an independent firm must comply with stricter operational procedures. Independent escrow companies are required to have an annual CPA audit, bond requirements, financial liquidity requirements and follow trust fund insurance guidelines.
